Terms and Conditions

1. General
1.1. SpaceUp Vienna (hereinafter “the event”) is organized by “Förderkreis Astronomie und Raumfahrt ‘Der Orion’”, a non-profit association founded and operated by non-professional volunteers (hereinafter “the Association”) on a best-effort basis and may be cancelled, postponed or modified for any reason. The program and agenda are subject to change.
1.2. Participants declare that they are or will be at least 18 years old (resp. age of full contractual capability in the participant’s home country) on the date of the event.
1.3. There will be no qualified physician on site during the event. Participants with health conditions requiring medication or other care need to bring any medical material or devices they need with them to the venue. Please contact us by sending an email to spaceupvienna@gmail.com if you have special needs and/or mobility restrictions.
2. Cancellation of Participation
Cancellations have to be sent to the Association via E-Mail to spaceupvienna@gmail.com. In case of cancellation up to 7 days before the event, the participation fee will not be refunded.
3. Safety and Liability
3.1. Participants attend the event at their own risk and declare that they have sufficient health, travel and accident insurance for their stay in Vienna and for their participation at the event.
3.2. Participants are responsible for the safety of all their belongings during the event. There will be no locker rooms, safes or other similar facilities available for participants. The cloak rooms or similar facilities will not be guarded nor supervised. Delivery of any item thereto will be entirely on the participants’ risk. Due to the number of persons present at the venue during the event, participants are urged not to bring any valuables to the event.
3.3. The participants are aware of the fact that they can be held responsible for any damages done to other persons as to physical damage to property due to their participation in the event. Participants will indemnify and hold the Association harmless for any damages that shall occur in the course of the event due to actual fault or negligence.
3.4. The Association shall be liable for any damage not covered by the scope of the Product Liability Act only if intent or gross negligence can be evidenced. Any liability of the Association for slight negligence as well as compensation for consequential damage and property damage, savings not realized, interest losses or damage resulting from third party claims shall be excluded.
3.5. The Association especially accepts no responsibility or liability for any loss or damage in case the event is cancelled, postponed or modified in any way with limited or no notice. Further, the Association accepts no responsibility or liability for any loss, theft, destruction or damage to participants’ property, including participants’ cars or other transportation means.
4. Intellectual property and Image Rights
4.1. All products and merchandising material used during the event remain the exclusive property of the Association both intellectually and physically. Participation in the event affords no right of whatever nature to such proprietary material.
4.2. Participants agree that photographs and videos of them could be taken in the course of the event. Participants hereby give their consent that these photos and videos can be used by the Association at any time and without restrictions during the event and also after its termination.
5. Miscellaneous:
5.1. Participation in the event and all relations between participants and the Association are regulated by Austrian Law with the exception of the rules of conflict of laws, private international law and under exclusion of United Nations Convention on Contracts for the International Sales of Goods, 1980 (UN-CISG). The Application of any “choice of law” rules is excluded.
5.2. If these Terms and Conditions or parts of it are deemed void, invalid and/or not enforceable, the void, invalid and/or not enforceable provision shall be replaced by a provision permitted under law which comes as close as possible to the purpose of the void, invalid and/or not enforceable provision. If one or more parts of this Agreement are void and/or not enforceable, this shall not affect the applicability of the other valid and enforceable parts of this Agreement.
5.3. Any and all disputes arising out of the participation in the event and all relations between participants and the Association, including disputes relating to the conclusion, validity, termination or nullity of this terms and conditions, shall be subject to the exclusive jurisdiction of the competent court of Vienna.

Participants confirm and acknowledge that they have read and accepted the contents of these Terms & Conditions. Participants will receive a copy of these Terms & Conditions together with the confirmation of participation by the Association.
